A war crime is a punishable offense, under international (criminal) law, for violations of the law of war by any person or persons, military or civilian. Every violation of the law of war in an inter-state conflict is a war crime, while violations in internal conflicts don't necessarily amount to war crimes.


Dusko Tadic will stay in Jail
On 7 May 1997, Trial Chamber II (Judges Gabrielle Kirk McDonald, Ninian Stephen and Lal Chand Vohrah) found the Appellant guilty on nine counts, guilty in part on two counts and not guilty on 20 counts. Specifically, the Trial Chamber convicted the Appellant of violations of the laws or customs of war pursuant to Article 3 of the Statute of the International Tribunal (“Statute”) under Counts 10, 13, 16, 22 and 33 of the Indictment. It further found the Appellant guilty pursuant to Article 5 of the Statute for having committed crimes against humanity in the form of “persecution” under Count 1 of the Indictment and “inhumane acts” under Counts 11, 14, 17, 23 and 34THE APPEALS CHAMBER
(1) DENIES the first ground of Appeal against the Sentencing Judgment of 14 July 1997 and AFFIRMS the sentences imposed upon the Appellant by the Sentencing Judgment of 14 July 1997;    (2) DENIES the first, third and fifth grounds of Appeal against the Sentencing Judgment of
   11 November 1999

The Serbian authorities, including the accused, killed hundreds of Muslim and Croatian detainees. The number of the victims would thus be much higher than the figure given for only those crimes to which the accused pleaded guilty 1999-12-14
